In Alabama, driving under the influence is a law that prohibits anyone from driving or being in actual physical control of a vehicle while under the influence of any impairing substance that makes a person incapable of safely operating a vehicle. Driving under the influence (“DUI”) includes the influence of alcohol (BAC of .08% or more), drugs or a combination of the two. Any persons that is operating a vehicle under the age of 21 and has a BAC of .02 or higher can receive a driving under the influence charge.

The DUI statute in Alabama states, that anyone who is in actual physical control of the vehicle can receive a driving under the influence charge- meaning you can receive a DUI without actually driving or having a vehicle in motion.

What are the Consequences of a DUI Charge?

The consequences for a DUI depend on if the person charged is a first, second- or third-time offender. Generally speaking, the 1st offense for a DUI is a misdemeanor that could result in 90 days suspension of driver’s license, up to possibly 1 year in jail and a minimum of 6 months driving with an Ignition Interlock Device and fines ranging from $600 to over $4000. The consequence for multiple DUI offenses can result into much more jail time, 1-3 years revocation of a drivers license and up to $10,000 of fines.
